Dispute Resolution & Litigation Services We Can Help With
Alternative Dispute Resolution
Alternative Dispute Resolution refers to a range of methods that provide alternatives to traditional litigation.
We offer our clients access to the full range of Alternative Dispute Resolution options. Often these options are more cost-effective to clients, less time-consuming than Court proceedings and lead to a better and more acceptable all-round conclusion for all parties concerned. The following options are available to our clients:
- Mediation – This is a collaborative process, facilitated by a neutral mediator. Mediation offers parties flexibility, control, confidentiality, and potential cost and time savings compared to court proceedings.
- Early Neutral Evaluation – An impartial assessment by a neutral evaluator providing parties with an early expert opinion, facilitating settlement discussions and saving time and costs compared to court.
- Expert Determination – An impartial expert makes a decision on specific issues, offering parties a quicker, cost-effective resolution alternative to court litigation.
- Arbitration and Adjudication Schemes (only in certain circumstances) – Private dispute resolution where an impartial arbitrator or adjudicator makes a binding decision.
- Lawyer-Supported Negotiation – Dispute resolution and litigation solicitors assist in negotiating agreements, offering guidance, expertise, and advocating for their clients’ interests to resolve disputes whilst avoiding litigation costs.

Dispute Resolution FAQs
At Alsters Kelley Solicitors, we understand that the cost of dispute resolution services is an important consideration.
However, due to the unique nature of each case, it is difficult to provide an accurate estimate of costs at the beginning of the case. There are various factors to consider, such as the complexity of the dispute resolution case, the number of parties involved, differing tactics and approaches, and your desired outcome.
We offer clients an initial fixed fee meeting of up to one hour at a cost of £400 plus VAT (20%) – total £480. This meeting allows us to understand your dispute resolution case and provide preliminary advice.
We record time spent on your dispute resolution case in units of six minutes. Routine letters, emails, texts, and telephone calls are charged at 1 unit. Bespoke letters, meetings, telephone conferences, and other work are charged based on the actual time spent on each item.
We always provide estimates for each stage of your matter and seek your instructions before proceeding with any additional costs.
If the estimate needs to be adjusted for any reason, your dispute resolution solicitor will inform you of the changes and seek your approval before proceeding. We also request payments on account before carrying out any work. This approach ensures transparency and allows us to maintain consistent billing practices.
At Alsters Kelley Solicitors, we are committed to providing a clear and transparent breakdown of dispute resolution costs, ensuring you have a comprehensive understanding of the fees involved throughout the process.
We understand that you may be curious about the timeline for resolving your dispute. However, it’s important to note that each dispute resolution case is unique, making it challenging to provide an exact timeframe.
There are several variables at play, such as the gathering of evidence, legal representation of the other party, legal requirements, and the specific procedures of different courts.
Rest assured, we are here to support you throughout the dispute resolution process. While we cannot give an accurate estimate, we will always try our best to give you a rough idea of the expected timeline. Furthermore, we will keep you updated if any changes arise or if adjustments to the timeline are necessary for any reason.
We aim to provide you with effective and timely dispute resolution services, ensuring that your needs are met and a satisfactory outcome is achieved.
Please feel free to reach out to us for any further clarification or updates regarding the progress of your dispute resolution case.

Alsters Kelley Solicitors Ltd has an excellent reputation for assisting clients who are eligible for Legal Aid.
Whilst several of our departments are able to utilise Legal Aid funding, we regret to inform you that it is not available for dispute resolution cases. All dispute resolution matters must be privately funded by clients.
However, please don’t worry. We are here to help you explore alternative funding options that may be appropriate for your situation. Our team can provide guidance and point you in the right direction to explore funding avenues that align with your needs.
We believe that everyone should have access to the assistance and support they require. Please feel free to discuss your specific circumstances with us, and we will work together to find the best solution to meet your needs.
Request an appointment to discuss the options available for funding your dispute resolution.
You may be wondering about the possibility of instructing us to act in your dispute resolution case under a “no win, no fee” or Conditional Fee Agreement (CFA). Whilst CFAs are often referred to as “no win, no fee” agreements, it’s important to clarify the details.
If your dispute resolution case is not successful, you will not be responsible for your own legal costs under a Conditional Fee Agreement.
However, it’s important to understand that even with a “no win, no fee” agreement, you may still be responsible for paying your opponent’s legal costs. This means that the agreement’s outcome isn’t fully captured by the term “no win, no fee.” It’s crucial to consider this aspect and discuss it with your solicitor to have a clear understanding of the potential financial implications involved.
You may also have heard of a Damage Based Agreement (DBA) which is also a form of ‘no-win, no fee’ agreement between a solicitor and client, under which the solicitor is paid an agreed proportion of the sums the client recovers in litigation.
At Alsters Kelley Solicitors Ltd, our general practice is not to enter into Conditional Fee Agreements.
However, we evaluate each case individually, considering its unique merits and prospects of success. In specific circumstances, we may agree to a Conditional Fee Agreement or a Damage Based Arrangement.
Please understand that if we are unable to offer you a CFA or a DBA, it does not diminish our belief in the potential success of your case.
There are alternative funding options available, and we can guide you towards suitable avenues if you are unable to privately fund your matter.
Please feel free to request an appointment to discuss your specific circumstances and funding requirements.

Misrepresentation occurs when one party makes false statements or conceals important information that influences the other party’s decision to enter into the contract.
The possibility of getting out of a contract depends on various factors, including the nature of the misrepresentation and the terms of the contract.
Our experienced team can assist you in assessing the circumstances surrounding the contract and the misrepresentation that took place. Request an appointment to discuss your situation further, and check out our blog post on getting out of a business contract for more information on this matter.
If someone has entered into court proceedings against your business, it’s important to note that there are legal avenues available to halt these proceedings if no attempt has been made to resolve matters outside of court.
At Alsters Kelley Solicitors, we strongly encourage parties to engage in alternative dispute resolution methods, such as mediation or negotiation, before resorting to court. These methods can often lead to more efficient and cost-effective business dispute resolutions while preserving relationships and minimising disruption.
