Motoring and driving offences – road traffic
Have you been accused of a driving offence? Frequently Asked Questions
As soon as you become aware that the police (or another organisation) are investigating you, or if you believe that you may have committed a crime, you need to call us. We can give you advice, represent your interests and make sure your rights are protected. We will also represent you in Court if it is neccesary.
It is your legal right to be offered free legal advice from a solicitor. As soon as you arrive at the Police Station you should ask the Custody Sergeant to contact Alsters Kelley Solicitors in order that we can attend to represent you. One of our solicitors will be available 24 hours a day, 7 days a week.
This depends on two things. Firstly, whether you are financially eligible. If you have disposable income, or capital, above a certain amount you may not be eligible for legal aid. Secondly it depends on how serious the case is. For very minor criminal offences you are unlikely to be granted legal aid unless there are other circumstances which would entitle you to get legal aid.
As soon as you receive a summons you should contact us immediately to give us the details of your scheduled court appearance. Motoring law can be complicated and the prosecution will usually be represented by an experienced prosecutor. It therefore makes sense to have an experienced lawyer fighting your corner. We will give you some initial advice over the telephone and make the necessary arrangements to represent you in Court.
An endorsement stays on your driving licence for four years from the date of conviction. However, there are three offences where there is an exception. For drinking/drugs and driving, causing death by careless driving while under the influence of drink or drugs and causing death by careless driving, then failing to provide a specimen, the offences will remain on your record for 11 years from the date of conviction.

I was introduced to Alsters Kelley whilst in Police Custody in a most bizarre and unpleasant set of circumstances, following a serious but false criminal allegation.
