Legal Aid can help meet the costs of legal advice and representation. Payment is made from public funds under a system set up by the Government.
At Alsters Kelley we are able to provide Legal Aid in family, clinical negligence and criminal defence cases.
The eligibility criteria for Legal Aid is set by the Legal Aid Agency. To qualify, you will need to show that your case is eligible for legal aid, your problem is serious and that you cannot afford to pay for legal costs.
Most family cases will be means tested. So, you will have to show that you cannot afford to pay legal costs. You will be required to give information about your income, benefits, savings, property and shares as well as those of your partner.
You may be required to make a contribution to your legal costs or to pay them back in full from damages, or through the statutory charge scheme. We will provide you with full information if you are eligible for Legal Aid.
For some cases you can get legal aid regardless of your financial means. For example, non means tested legal aid is available if your child is a subject of care or supervision proceedings.
The advice and representation you receive will be of the same high standard as if you were paying privately.
