The Claimant suffered an injury at work on 8/7/15. He was removing parking camera equipment from a supermarket and had been provided with a fiberglass stepladder.
However, as he was unable to place the ladder straight underneath the Wi-fi sender as there was a sunken doormat in front of the fire door, he positioned the ladder directly under the Wi-fi sender. He went up the ladder and whilst trying to remove the parking camera equipment, the ladder slid backwards, and our client fell upside down onto the floor.
As he was falling, he hit the side of his jaw on a windowsill. He was taken to hospital where he was diagnosed as having a dislocated right non-dominant shoulder. On further examination the following day, it was found that 25% of the humerus bone was displaced and had come out of its socket, and some tendons had come off the bone. He underwent an operation to have a metal plate and screw inserted. He had to leave his employment.
Our Claimant alleged that he was never given above height training, something the Defendant disputed. A 70/30 contributory negligence in our client’s favour was agreed and our client received £45,000.
