This week marked the introduction of no-fault divorce, aimed at reducing conflict between separating couples and making the entire process simpler.
The Divorce, Dissolution and Separation Bill is the biggest shake-up of divorce laws for 50 years. The no fault divorce will finally put an end to the blame game for couples wanting to split amicably, because it finally removes the need to blame the other party for the breakdown of the marriage or otherwise live apart for a minimum of two years.
Irretrievably broken down
Under the new legislation, either one, or both of the parties, can start the divorce process by confirming that the marriage has irretrievably broken down. The same no-fault rule applies to same-sex marriages and civil partnerships too.
Not a quickie divorce
It is worth remembering however, that the new law does not deliver an instant divorce. It clearly lays down a minimum allowable period of 20 weeks between the initial application and the conditional order, and another six weeks between the conditional and final orders. It is only upon pronouncement of the final order that the marriage is brought to an end. This means that even the smoothest divorce will take at least six months to complete.
