Mrs R had undergone pancreatectomy and splenectomy as a result of cancerous tumours. Unfortunately, just over a year later, an MRI scan identified a tumour on her liver. A decision was made to surgically remove the tumour, rather than removal by thermal ablation, and in order to reach the tumour Mrs R was consented to have her gallbladder removed.
Mrs R underwent cholecystectomy (removal of the gallbladder) and resection of the tumour. Histology from the tumour was sent for screening, however it became apparent that healthy tissue had been removed during the operation and the malignant tumour had been missed.
Following the failed resection, Mrs R had to undergo further surgery by way of thermal ablation for her tumour under general anaesthetic. She suffered incision site burning.
Mrs R suffered anxiety as a result of the failed operation and that the tumour remained present for months longer than it should have been. Mrs R had to undergo counselling and take further time off work to undergo the ablation surgery and thereafter recover.
We successfully settled the claim against The Trust and secured a five figure settlement on her behalf.
