Prescriptions & Medical Devices
Drugs and medical devices are used widely throughout the medical profession and are successful in treating a huge range of conditions. Sometimes patients can experience problems and occasionally, these problems arise as a result of poor care or faulty products.
Prescriptions
Prescription errors can occur, either as a result of a lack of care by a doctor, or as a result of a mistake made by the pharmacist. Mistakes are rare, but giving a patient the wrong drug can have serious consequences. Sometimes, certain drugs should not be prescribed with other drugs, as a reaction can occur. Other drugs need careful monitoring to ensure toxic levels are not reached. If you have been given the wrong drug, or have concerns about how your medicine has been prescribed, you should seek legal advice as you may be able to pursue a claim for negligence.
Medical Devices
The making and use of medical devices is governed by the Consumer Protection Act 1987. This sets down strict rules on how products are manufactured and sold and also applies to medical products and devices. This is to ensure the public is protected and to ensure all products are safe. If a device is defective, you may be able to pursue a product liability claim.
Common medical devices where problems are known to have arisen are hip replacements, breast implants, drugs, plates and pins in fracture treatment, and heart valves.
These product liability claims are complex and require specialist legal advice. Our solicitors are experienced in investigating these types of claims and can talk you through what is involved and whether you might have a claim.
