Libel danger lurks on the net

Business people need to beware the dangers of being caught out by posting information about others and their businesses on the internet.

The warning from Coventry and Warwickshire solicitors Alsters Kelley comes as it sees a marked rise in the number of inquiries from people who think they have been electronically defamed by others.

Litigator Fiona Samuda says that ignorance of the law often leads to actions being pursued. "People will often mistakenly view the internet as somewhere you can post your views without restriction. In fact, it is as much a public document as a daily newspaper and, increasingly, is where people will go first for information.

"Anyone who posts something factually incorrect about another person or business may well find themselves on the wrong end of a writ. Added to this, there is no public funding for defamation so the scales are tipped in favour of the person with the most money.

"The advice has to be: think before you type. Because it is so easy to access the internet, it is also very easy to act quickly before engaging your brain properly and as in most walks of life that is a mistake.

"If you do find yourself being pursued, however, a simple apology and removal of the offending item will often suffice.  However it is best to seek legal advice before taking these steps.”

She added that damages for libel had no limit to them, placing would-be defendants at greater financial risk.
