Who are we?

We are a specialist department within the firm, with many years of experience in dealing with a wide variety of medical negligence claims. We are able to advise clients on all aspects of medical law.

What is Medical Negligence?

The majority of us will receive perfectly adequate care from healthcare professionals. Unfortunately, there are times where the care and treatment received is not of a reasonable standard, which can have devastating effects on an individual. We understand that those effects can be broad ranging in terms of physical, emotional and financial well being.

Medical Negligence refers to a claim against a member of the medical profession, for example, a Doctor, Nurse, GP, Paramedic, Pharmacist, Therapist or Dentist. Claims for Medical Negligence are often very complex and it's extremely important that you have a solicitor who is experienced and understands the issues involved in such a case. Here at Alsters Kelley we have a dedicated department dealing with Medical Negligence and, therefore, have the expertise that will be required in your case.

What we do

We act on behalf of clients against both NHS Trusts and Private Practice consultants. The type of cases that we deal with are wide ranging, and include;

  • Birth Injury claims on behalf of the child and the mother (including Cerebral Palsy and Erb's Palsy claims)
  • Spinal Injury claims
  • Misdiagnosis and Failure to Diagnose claims
  • Injuries caused by negligent surgical technique
  • Wrongful Birth claims
  • Misdiagnosis of Meningitis and Brain Tumour claims
  • Hospital Acquired Infection claims
  • Anaesthetic Error claims
  • Fatal Accident claims

We are also able to represent clients, and advise generally, in relation to Inquest Hearings at the Coroners Court.

We can advise you about the NHS Complaints Procedure, which is an essential part of starting an investigation into a Medical Negligence claim.

Our Team

The Medical Negligence Department is run by Louise Hunt, who is a qualified Nurse. Louise has been undertaking Medical Negligence cases for over 12 years and is a member of both the Law Society Clinical Negligence Panel and the AvMA Referral Panel.

Kathryn Turner is a Solicitor within the Department, who was previously a Healthcare Assistant and also has extensive experience in conducting Medical Negligence cases.

Funding

We can provide initial free advice to you, if you have been a victim of a medical accident. If we are able to take on your case the claim can be funded in a number of different ways;

  • Legal Services Commission Funding
  • Private Funding
  • Legal Expenses Insurance Funding
  • No Win No Fee

We hold a Legal Services Commission franchise and are one of the few firms in Warwickshire and the West Midalnds that do so. Legal Services Commission Funding is subject to eligibility criteria being satisfied, which we can advise you upon.

Associated Services

The firm is able to offer commercial and private services to clients. In a medical negligence claim, a client will often need to be advised on a wide variety of issues, including;

  • Investment of compensation monies
  • Welfare Benefits
  • Powers of Attorney
  • Court of Protection work
  • Making Wills
  • Creating Trusts
  • Mental Health issues

We are able to offer a comprehensive service to clients, advising on all of the above matters.
