We offer advice on all aspects of family law affecting both married people, people living together and those who are separated.

Collaborative Law - Finding Solutions Together
It is a sad fact of life, that divorce is here to stay. The most recent statistics suggest that almost half UK marriages will end in failure. The real cost of relationship breakdown is not merely financial, though anyone who has been through the process will know how costly court battles over splitting assets can be. The real cost is in the personal and emotional turmoil so often accompanies the end of relationships. A bad divorce can leave lasting scars not just on the two main protagonists but on their children, extended family and support network too. Many of Alsters Kelley Lawyers are members of Resolution who commit to adopting a non confrontational approach to divorce and encourage couples to seek shared solutions and to reach agreement without referring the matter to the court. However the process can still be adversarial in nature and Alsters Kelley is therefore also able to offer separating couples the opportunity to work together within the Collaborative Law Process, to settle the matter without the involvement of the court, to significantly reduce personal and emotional turmoil that so often accompanies the end of relationships. Lawyers who practice the Collaborative approach have all the technical legal expertise that you would expect and additionally they have extra training in how to work collaboratively. Within the collaborative process you sit down together with your former partner, your solicitor and their solicitor and commit to sorting the problems out together. You can share hopes, aspirations and expectations and the four of you work together to create an agreement with which you all concur. This collaborative approach will give you the best opportunity to emerge from the process ready to get on with the rest of your life, without the bitterness or unresolved anger that so often accompanies divorce and separation. Collaborative Law is not necessarily an easy option, it requires the right mind set from everybody involved. It may not be cheaper financially than a well managed traditional approach. For couples for whom it is right it provides a genuine resolution to marital or relationship breakdown and for those who come out of the other end report a genuine sense of well being. Many successfully remains friends with their former partners in an atmosphere of respect and understanding which sends out remarkably positive signals to children, who benefit hugely from knowing that their parents are working out their differences together constructively. Financing Your Legal Representation in Family Proceedings
The question of how to fund your legal representation when there is a relationship or family breakdown can be a matter of very great concern and practical difficulty at a time where there are already significant personal and financial pressures arising out of the relationship breakdown. We at Alsters Kelley are acutely aware of the difficulties that our clients can experience and we remain committed to undertaking Publicly Funded work (Legal Aid) for those clients eligible. However increasing numbers of our clients are outside of the eligibility criteria for public funding and therefore, we have worked closely with Barclays Bank in order to offer our clients the opportunity to delay payment of our client’s legal costs until they can best afford them, usually at the time that financial settlement is agreed either by way of negotiation or court proceedings. By opening a client credit account from Barclays Bank you will be able to finance the costs of your representation and at the same time reduce a significant area of concern and anxiety during the course of your matter. Using the Barclays Client Credit account could not be easier. Once opened you simply instruct your solicitors to charge through your client credit account and Barclays Bank will then make payment directly to Alsters Kelley on your behalf. Every time you use the account to make payment, we will send you details of the transaction and confirmation of the balance outstanding from your account. Alsters Kelley will of course continue to account to you for the work undertaken on your behalf and you will receive copy invoices detailing the work carried out on your behalf. You will also continue to receive from Alsters Kelley a clear cost estimate for the work to be undertaken and receive regular updates of the cost of proceedings to date. While using the client credit account you will need to pay the interest charged to the account each month but you do not have to repay the monies advanced until your case is completed or after 24 months if this is sooner. The monthly repayments on the scheme roughly equate to 0.9% per month, so for instance should your legal fees be £5,000, your monthly repayments would only be £45 per month. Clearly as the capital monies will have to be repaid to Barclays Bank either at the conclusion of your case or within 2 years of joining the credit scheme. It is essential, that when you are signed up to the scheme both you and your solicitor are confident, that the resulting financial settlement will provide you with sufficient capital in order to be able to discharge sufficient lump sum to discharge the costs incurred in dealing with your matter. The client credit scheme is therefore not suitable for all clients and of course is only one of the options that are available to our clients in order that they can fund the very best legal representation. We believe that offering our clients this alternative means of funding legal representation will be of very real benefit to many of our clients.
